Submittee Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Submittee service ("Service"). These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and Submittee Pty Ltd ("Submittee," "we," "us," or "our"). By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Service Description

1. Submittee provides shadow-writing services for planning application objection letters and other planning submissions (“Submission Response(s)”). Our writers will draft the Submission Responses on behalf of the Customer, with the understanding that the intellectual property rights belong solely to the Customer. The Customer's preferred planning outcome is not guaranteed by Submittee.

Content Ownership and Liability

2.1 Intellectual Property: All Submission Response created by Submittee as part of the shadow writing service is considered the intellectual property of the Customer. Submittee will not claim ownership or responsibility over any Submission Responses created on behalf of the Customer. The Customer retains full ownership and responsibility for the Submission Response.

2.2 Customer Responsibility: The Customer acknowledges that they are solely responsible for the accuracy, legality, and appropriateness of the content provided to Submittee for shadow writing. Submittee does not assume any responsibility for the Submission Responses and cannot be held liable for any consequences resulting from their use.

2.3 No Guarantee of Outcomes: Submittee does not guarantee that the Customer will achieve their preferred planning outcome by using our shadow writing services. The final decision regarding planning applications rests with the relevant authorities or decision-making bodies, and Submittee has no control over these decisions.

48 Hour Turnaround Guarantee

3. If Submittee cannot complete your Submission Response within 48 hours, we’ll supply the report for HALF the quoted price.

Date and time of completion of the Submission Response is defined as the time the Submission Response is sent from Submittee to the Customer, either requesting additional information or supplying the Submission Response..

Limitation of Liability

4. To the maximum extent permitted by law, Submittee, its officers, directors, employees, affiliates, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses arising out of or in connection with the use or inability to use the Service or any content generated by Submittee.

Indemnification

5. You agree to indemnify and hold Submittee, its officers, directors, employees, affiliates, and agents harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your use of the Service or any violation of these Terms.

Modifications to the Service

6. Submittee reserves the right to modify, suspend, or discontinue the Service, or any part thereof, at any time and without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Governing Law and Jurisdiction

7. These Terms shall be governed by and construed in accordance with the laws of Australia, regardless of the state or territory in which the Customer resides or accesses the Service. Any dispute arising out of or in connection with these Terms, including but not limited to disputes related to the use of the Service or the content generated by Submittee, shall be submitted to the non-exclusive jurisdiction of the courts of Australia.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

By using the Submittee, you acknowledge that the laws of Australia govern these Terms and any disputes arising from or relating to the use of the Service. You agree to submit to the non-exclusive jurisdiction of the courts of Australia for the resolution of any such disputes.

Please note that while Submittee offers its shadow writing service across Australian states and territories, the jurisdiction clause does not limit or restrict the application of any specific state or territorial laws within Australia. The choice of Australia as the governing law and jurisdiction is made for the overall consistency and coherence of the Terms.

Entire Agreement

8. These Terms constitute the entire agreement between you and Submittee regarding the use of the Service and supersede any prior agreements or understandings, whether written or oral.
